Kylie Chiseul Kim is a partner in the Washington, D.C. office of Massey & Gail LLP.

Kylie represents clients in high-stakes trial and appellate cases as well as proceedings before administrative agencies.  She frequently practices at the intersection of law and technology and has challenged the SEC’s regulatory authority over digital assets, prosecuted antitrust claims in the life-sciences software and digital communications industries, and represented Amazon’s music streaming business in a rate-setting proceeding before the U.S. Copyright Royalty Board.  Kylie has earned recognition in The American Lawyer’s Litigators of the Week list for her contribution to a Ninth Circuit win in a federal preemption action challenging a municipal ban of natural gas piping.

Her representations have resulted in numerous victories, including:

  • California Restaurant Association v. City of Berkeley, No. 21-16278 (9th Cir.) – Won a Ninth Circuit appeal on behalf of the California Restaurant Association challenging the City of Berkeley’s ban on natural gas piping under federal preemption grounds.
  • SEC v. Ripple Labs Inc. et al., No. 1:20-cv-10832 (S.D.N.Y.) – Secured partial summary judgment and excluded key economic expert testimony in a Section 5 lawsuit by the SEC against financial-technology company Ripple.
  • Cisco Systems, Inc. et al. v. Dexon Computer, Inc., No. 3:20-cv-04926 (N.D. Cal.) – Secured dismissal of federal antitrust claims against digital communications company Cisco Systems.
  • IQVIA Inc., et al. v. Veeva Systems, Inc., No. 2:17-cv-00177 (D.N.J.) – Defeated a motion to dismiss federal antitrust claims on behalf of life-sciences software company Veeva Systems.
  • Emerson v. Fla. Dep’t of Rev., et al., No. 21-CA-00487 (Fla. 2d Jud. Cir.) – Delivered successful oral argument against a motion to dismiss or stay in a taxpayer class action for the refund of Hillsborough County’s unconstitutional tax in Florida state court.
  • Glaz LLC et al. v. Sysco Corporation, No. 1:23-cv-02489 (S.D.N.Y.) – Obtained and defended an arbitral panel’s grant of a preliminary injunction in favor of industry-leading litigation finance company Burford Capital.
  • Phonorecords IV, No. 21-CRB-0001-PR (2023-2027) – Represented Amazon Music in a mechanical rate-setting proceeding before the Copyright Royalty Board, which concluded in an industry-wide settlement on the eve of trial.

Prior to private practice, Kylie clerked for The Honorable Charles R. Wilson, United States Court of Appeals for the Eleventh Circuit, and The Honorable Steven D. Merryday, United States District Court for the Middle District of Florida.

Kylie received her law degree from Harvard Law School, where she served as Captain of the Willem C. Vis International Commercial Arbitration Moot Team, Executive Online Editor of the Harvard International Law Journal, and Article Editor of the Harvard Environmental Law Review.
